These Terms & Conditions (“Terms”) govern your use of the Rustic Barnyard website and your reservation of accommodations at Rustic Barnyard in San Marcos, Texas. By accessing our website or completing a reservation, you agree to be bound by these Terms.

1. Reservations & Payment:

All reservations are subject to availability and confirmation.

A deposit of 50% of the total reservation amount is required at the time of booking.

The remaining balance is due 14 days prior to arrival.

If a reservation is made within 14 days of arrival, full payment is due at booking.

Failure to remit payment when due may result in cancellation of the reservation without refund of amounts previously paid.

2. Cancellation Policy:

Cancellations made 5 or more days prior to arrival will receive a full refund of all amounts paid.

Cancellations made within 5 days of arrival are non-refundable.

No refunds will be issued for:

• Early departures

• No-shows

• Weather conditions

• Travel delays

• Illness

• Acts of God or events beyond our control

Travel insurance is strongly recommended.

3. Payment Disputes & Chargebacks:

By providing a payment method, the guest authorizes Rustic Barnyard to charge the card on file for:

• Reservation charges

• Applicable taxes

• Damages

• Excessive cleaning

• Additional approved fees

Guests agree not to initiate chargebacks for valid charges related to their reservation.

In the event of a payment dispute, Rustic Barnyard reserves the right to provide this agreement, reservation records, communications, and supporting documentation to the financial institution or card issuer.

4. Check-In & Check-Out:

Check-in: 4:00 PM

Check-out: 10:00 AM

Early check-in or late check-out is not guaranteed and must be approved in advance.

Unauthorized late departure may result in additional charges.

5. Occupancy Limits:

Maximum occupancy for each cabin is stated on the website and must not be exceeded.

Unauthorized guests may result in:

• Additional charges

• Immediate termination of reservation

• Removal from property without refund

6. Quiet Hours & Events:

Rustic Barnyard is designed as a peaceful Hill Country retreat.

Quiet hours are observed between 10:00 PM and 8:00 AM.

Parties, events, or gatherings beyond registered guests are not permitted without prior written approval.

Violation of this policy may result in immediate termination of the reservation without refund.

7. Farm, Animals & Rural Property Acknowledgment:

Rustic Barnyard is located on a rural property that includes natural terrain, wildlife, and animals.

Guests acknowledge and agree that:

• Outdoor areas may contain uneven ground, gravel, insects, wildlife, and natural hazards

• Animals may be present on or near the property

• Guests must supervise children at all times

By staying at Rustic Barnyard, guests voluntarily assume all risks associated with a rural environment and agree to hold harmless and release Rustic Barnyard, its owners, and representatives from any claims, injuries, damages, or losses arising from ordinary outdoor or farm-related conditions.

8. Pool Use & Assumption of Risk:

Rustic Barnyard may provide access to a swimming pool or similar water feature.

Guests acknowledge that:

• Use of the pool is at their own risk

• There is no lifeguard on duty

• Children must be supervised at all times

• Pool areas may present slip and fall risks

By using the pool, guests voluntarily assume all risks associated with swimming and water activities and agree to release and hold harmless Rustic Barnyard from liability for injury, illness, or accident related to pool use.

9. Pets:

Only one designated cabin allows medium to small dogs and must be approved in advance.

Pets are not permitted in other cabins unless prior written approval is granted by the host.

Additional pet fees may apply.

Unauthorized pets may result in:

• Additional cleaning fees

• Cancellation of reservation without refund

Guests are responsible for their pets at all times.

10. Damage & Security:

Guests are responsible for any damage caused during their stay.

Rustic Barnyard reserves the right to charge the card on file for:

• Property damage

• Missing items

• Excessive cleaning

• Smoking violations

• Pet violations

11. Amenities & Interruptions:

While we strive to maintain all amenities as described, Rustic Barnyard does not guarantee uninterrupted access to:

• Wi-Fi

• Utilities

• Appliances

• Outdoor amenities

No refunds will be issued for temporary outages beyond our control.

12. Limitation of Liability:

Rustic Barnyard, its owners, and representatives shall not be liable for:

• Personal injury

• Illness

• Loss of personal belongings

• Accidents

• Delays

• Acts of nature

• Events beyond our control

Guests assume full responsibility for their safety and belongings during their stay.

13. Indemnification:

Guests agree to indemnify, defend, and hold harmless Rustic Barnyard, its owners, agents, and representatives from any claims, damages, losses, liabilities, or expenses arising from the guest’s use of the property or violation of these Terms.

14. Governing Law & Venue:

These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas.

Any legal action arising from a reservation shall be filed exclusively in the appropriate court located in Texas.

15. Website Use:

All website content, including images and text, is the property of Rustic Barnyard and may not be copied or used without permission.

16. Acceptance of Terms:

By using our website and completing a reservation, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

Guests must check the acknowledgment box confirming agreement to these Terms prior to completing a reservation.
